GENERAL CONDITIONS OF USE
Before using the Services proposed by KNOWLEDGE TO DECIDE, the User agrees to read and accept the Terms and Conditions. By registering as a User, the User undertakes to respect these General Terms and Conditions. By making continued use of the APP/PLATFORM, the User acknowledges that he/she is fully informed and accepts the provisions of the General Terms and Conditions and undertakes to respect them. If you do not accept the General Terms and Conditions, you will not be able to continue the subscription process and you will not be able to use the Services proposed in the APP/PLATFORM KNOWLEDGE TO DECIDE. These rules have been adopted in accordance with the legislation to guarantee the freedom of the Users as well as a quality Internet Service.
KNOWLEDGE TO DECIDE: Proveedor de servicios encargado de la gestión de la APP/PLATAFORMA, ofrecido por la empresa KNOWLEDGE TO DECIDE, SL sociedad limitada española provista de Número de Identificación Fiscal B66755919 y domicilio en 08301 Mataró (Barcelona)), calle Sant Bonaventura, nº 34, 1º Derecha. CGU: Condiciones Generales de Uso conformadas por el presente contrato y que resultan aplicables, sin restricción ni limitación alguna, al conjunto de los Servicios propuestos por KNOWLEDGE TO DECIDE. Cuenta de Usuario: Servicios básicos (Perfil, Correo electrónico) que permiten al Usuario disponer de una identidad en la red social virtual de la APP/PLATAFORMA e interactuar con los otros Usuarios, empresas y/o portales de empleo registrados en la APP/PLATAFORMA. Servicios: Se refiere al conjunto de servicios, de pago o gratuitos, disponibles para los Usuarios de la APP/PLATAFORMA, cuyo objetivo es generar un informe de competencias del usuario para proporcionarle y poner en contacto al mismo con empleadores, que se conectarán a través de portales de empleo y publicarán sus ofertas, y podrá comparar con el perfil requerido por los puestos de trabajo descritos en nuestra plataforma. APP/PLATAFORMA: Aplicación con nombre D'Anchiano. Usuario: Internauta con edad hábil y legal para ser empleado o emplear y que ha aceptado las CGU.

2.1. Requisitos para ser Usuario Para ser Usuario de la APP/PLATAFORMA, es necesario: -Tener como mínimo la edad hábil y legal para ser empleado o emplear en virtud de la legislación concreta que le sea aplicable. -Haber leído y aceptado las CGU. -Completar los campos obligatorios del formulario de suscripción. -Que su contrato no haya sido resuelto (cuenta borrada) más de dos veces. El Usuario garantiza la autenticidad y veracidad de las informaciones suministradas y se compromete a mantenerlas actualizadas a través de su Cuenta de Usuario. KNOWLEDGE TO DECIDE no dispone de los medios técnicos y/o legales para verificar la exactitud de la pretendida identidad de los Usuarios y no se hace responsable de la exactitud o inexactitud de dicha información. Sin embargo, en caso de que existan dudas sobre la exactitud de las informaciones suministradas por el Usuario (y en particular sobre su edad)), o en caso de que terceros u otros Usuarios comuniquen información que induzca a pensar que existe usurpación de identidad o falsedad en las informaciones suministradas por un Usuario sobre su identidad, KNOWLEDGE TO DECIDE podrá:

Subscription form / Mandatory information To register for the Services, and in particular to complete the subscription form, is compulsory to register for the Services and to sign a contract with KNOWLEDGE TO DECIDE. . The following information must be communicated by the User: CANDIDATES -name and surname, -email address, -sex, - people in charge, -date of birth, -password, -level of studies, -current company, -number of employees of the company, -current position, -professional level - job function, -industry, -country, -province or state, -city, -zip code. COMPANIES and ASSOCIATES -name of the company, - Tax identification number (or equivalent), -email address, -password, -number of employees, -sector, -country, -province, -city, -zip code, -address, -name and surname of the contact person. POSITIONS -job dependents, -professional level, -function, -sector, -country, -province, -city, -zip code.
2.3. Informaciones facultativas El Usuario puede comunicar a través del portal a otros Usuarios o de forma pública una fotografía del perfil, así como cualquier información personal que el Usuario desee difundir públicamente, sin que pueda difundirse las informaciones siguientes: -los datos de contacto personales de terceros (número de teléfono, dirección mail, datos bancarios, etc.)), -propósitos de naturaleza discriminatoria, injuriosa, violenta o que suponga o incite a la comisión de un delito. Cuando el usuario quiera compartir vínculos de hipertexto o equivalentes a otros sitios Web o contenido de terceros, deberá asegurarse, bajo su completa responsabilidad, que no se estén vulnerando derechos de Propiedad Intelectual. La APP/PLATAFORMA pone a disposición de los usuarios un sistema mediante el que podrán conocer qué usuario o empresa ha visualizado su perfil de competencias y/o ha comparado su perfil de competencias profesional. Por lo tanto, la usabilidad de la Web será información susceptible de ser compartida con otros usuarios.
2.4. Article 3: Description of the prices of services

3.1. Service Options On our website (https://danchiano.com/landing/pricing-company) you will find a description of our Service options. Certain options are offered free of charge. The D'Anchiano Service that does not require payment is currently called "Free". Other options require payment before you can access them. We may also offer special promotional plans, subscriptions, or services. We reserve the right to change, terminate or otherwise modify the offer of our subscription plans, as well as our promotional offers, at any time, in accordance with these Terms and in accordance with any terms applicable to such plans and offers.
3.2. Trial Periods From time to time, we may offer, or others may offer on our behalf, proof of Paid Subscriptions for a specified time without payment or on a reduced fee basis (a "Trial Period"). D'Anchiano may determine your suitability for a Trial Period and may withdraw or modify such Trial Period at any time, without notice and without liability, to the extent permitted by applicable law. For some Trial Periods, we will ask you to provide your payment details to start that Trial Period. By providing such data, you agree that we may automatically charge you for the Paid Subscription on the first day after the end of the Trial Period, on a monthly basis or at any other interval of which we inform you in advance. IF YOU DO NOT WISH TO BE CHARGED THIS FEE, YOU MUST CANCEL THE RELEVANT PAID SUBSCRIPTION BEFORE THE END OF THE TRIAL PERIOD.
3.3. Pagos, cancelaciones y periodo de reflexión (derecho de desistimiento) Facturación D'Anchiano puede modificar en cualquier momento el precio de las Suscripciones de Pago, incluyendo cuotas de suscripción periódicas o de los Códigos, y le informará de cualquier modificación que realice en los precios con antelación y, si corresponde, de cómo aceptar esos cambios. Los cambios de precios aplicarán al comenzar el siguiente período de suscripción después de la fecha en que se haya realizado el cambio de precio. En la medida en que lo permita la legislación aplicable, el hecho de seguir utilizando el Servicio de D'Anchiano después de que el cambio de precio entre en vigor, implicará una aceptación del nuevo precio. Si no está de acuerdo con el cambio de precio, tiene derecho a rechazar el cambio mediante la cancelación de la Suscripción de Pago antes de que el cambio de precio sea aplicable. Al suscribirse a una Suscripción de Pago nos reservamos el derecho de ofrecerle la posibilidad de disentimiento para recibir un reintegro del importe total abonado en un plazo de catorce (14) días naturales contados desde el día en el que se suscribió al servicio en cuestión (el "Período de Reflexión")), de conformidad con las siguientes disposiciones:
- Si se suscribe a un Periodo de Prueba, acepta que el Periodo de Reflexión para dicha Suscripción de Pago, en relación con la cual recibe la prueba, termina tras la finalización de ese Periodo de Prueba (periodo que en ningún caso será inferior a 14 días naturales). Si usted no cancela la Suscripción de Pago antes de que termine el Periodo de Prueba, pierde el derecho a desistir y autoriza a D'Anchiano para que le cobre el precio acordado, con la periodicidad pactada, hasta que usted proceda a la cancelación de la Suscripción de Pago.
- Si usted adquiere una Suscripción de Pago sin Periodo de Prueba, autoriza a que D'Anchiano le cargue el cobro automáticamente, con la periodicidad pactada, hasta que usted proceda a la cancelación. Usted acepta que el Periodo de Reflexión estará disponible durante el plazo de catorce (14) días naturales tras su compra pero que el mismo se pierde una vez usted haya utilizado el Servicio de D'Anchiano durante dicho periodo.
Renewal, Cancellation and Plan Change Your Paid Subscription will automatically renew at the end of the applicable subscription period, unless you cancel your Paid Subscription before the end of that period. KNOWLEDGE TO DECIDE is not responsible for the «real» relationships that arise between the Users or with third parties that arrive through the APP/PLATFORM. KNOWLEDGE TO DECIDE does not guarantee that the Services work in case of interruption of the user's Internet access or in case of non-functioning or bad conditions of access originated by the Internet network jam as well as for any other reason of force majeure, not attributable to KNOWLEDGE TO DECIDE or its partners.
Article 7: Intellectual property
7.1. Users are strictly prohibited from modifying, copying, reproducing, downloading, disseminating, transmitting, exploiting for commercial purposes and/or distributing in any way the Services, the pages of the APP/PLATFORM or the computer codes of the elements comprising the Services and the APP/PLATFORM. The Employment Portals are authorised to exploit the contents of the APP/PLATAFORMA on their portal in accordance with the law.
7.2. Derechos cedidos por los Usuarios Los Usuarios son titulares de los derechos de propiedad intelectual de los contenidos e informaciones publicados en la APP/PLATAFORMA y conceden a KNOWLEDGE TO DECIDE, en el marco de los Servicios, una licencia de explotación no exclusiva de dichos derechos sobre los contenidos e informaciones de carácter público. Esta licencia de explotación comprende, sin perjuicio de las disposiciones del Art. 8.1 de las CGU, el derecho de KNOWLEDGE TO DECIDE a reproducir, representar, adaptar, traducir, digitalizar y utilizar para los fines del Servicio, los contenidos e informaciones públicas relativas a los Usuarios (imágenes, videos, descripción, criterios de búsqueda, etc.)), en todo o parte de los Servicios de KNOWLEDGE TO DECIDE (en la APP/PLATAFORMA, por mail, etc.)), en los mailings de KNOWLEDGE TO DECIDE y más generalmente, en cualquier soporte de comunicación electrónica utilizado (mails, SMS, MMS, WAP, Internet) en el marco de los Servicios. En especial, el usuario conoce y autoriza a que KNOWLEDGE TO DECIDE llegue a acuerdos con plataformas de terceros que se conectarán a los datos de nuestra APP/PLATAFORMA. Los Usuarios, al inscribirse en la APP/PLATAFORMA autorizan expresamente a KNOWLEDGE TO DECIDE a publicar su foto en su perfil y a que su foto, su seudónimo, su localización geográfica y su edad sean publicados tanto en la APP/PLATAFORMA (visibles también a los no Usuarios) como en cualquier video y/o documento en el que KNOWLEDGE TO DECIDE promocione la APP/PLATAFORMA y sus Usuarios. Los Usuarios autorizan expresamente a KNOWLEDGE TO DECIDE a modificar los contenidos públicos mencionados anteriormente de forma que se respete la carta gráfica de los Servicios de KNOWLEDGE TO DECIDE o los otros soportes de comunicación indicados y/o hacerlos compatibles con sus características técnicas o con los respectivos formatos de soporte. Estos derechos son concedidos por los Usuarios en todo el mundo y durante toda la duración del contrato entre el Usuario y KNOWLEDGE TO DECIDE. Los Usuarios tienen prohibido copiar, reproducir o utilizar a título personal y privado los contenidos relacionados con los otros Usuarios para otros fines que no sean los propios de los Servicios.
Article 8: Sanctions and termination of the contract

Article 9: Modification of the general conditions of use KNOWLEDGE TO DECIDE reserves the right to modify, at any time and without prior notice, these Terms and Conditions to adapt them to new legislation or case law as well as to changes or practices in the economy or sector, taking into account at all times the legitimate interests of the Users, the User must periodically consult these conditions, terms and policies in order to check or ensure the existence of changes or modifications to them, taking as a reference the date of the last update. All this without prejudice to the non-affection of changes to contracts already signed. Article 10: Applicable law Pursuant to Article 23 of Law 34/2002, of 11 July, on information society services and electronic commerce, contracts concluded by electronic means such as the present one shall be fully effective and shall be governed by the legal system, provided that consent and other requirements for their validity are met. These terms and conditions are available to all KNOWLEDGE TO DECIDE customers free of charge. Access to the contracting process is completely free of charge, with no additional associated costs, other than those incurred by the Customer through an Internet connection. Each and every one of the products offered is duly described in the product sheet that will always be available to customers, not understood to include those issues that have not been expressly indicated in the same. It is considered that the contracting is perfected as soon as the User presses the "Accept" button, understanding that the monitoring of all the phases of the electronic contracting procedure and the inclusion of all the data requested imply, together with the express final acceptance of the present conditions, a clear and direct manifestation of the will of the final Client to accept the present general conditions of the contracting. KNOWLEDGE TO DECIDE, as a service provider of the Information Society, will store in a durable medium the electronic document in which this contract is formalised. At the time of confirmation of registration, the user will have a link available to download the contract document.
Article 11: Competent Jurisdiction Any controversy regarding the GCU will be substantiated before the Courts and Tribunals of Barcelona.
Article 12: Partial nullity If any clause of the GCC is declared null and void by application of any law or regulation or by any competent authority, the aforementioned provision or clause shall be deemed not to have been put into effect, and the contract shall continue to be fully in force between the parties with respect to the other clauses, and shall be interpreted in accordance with the contractual will expressed by the parties in this document.
DESCRIPTION OF THE OPERATION FOR CANDIDATES 1. The candidate is registered, completing a form of essential data that contains a part of the fields listed in section 2.2 of this document. 2. The candidate performs a professional skills (Competencies) test, consisting of a questionnaire of 108 pairs of sentences. The candidate must choose only one sentence in each pair. 3. Once the test is finished, the candidate completes a form of complementary data that contains another part of the fields related in section 2.2 of this document. 4. After completing the supplementary data form, the candidate will be able to see a summary report and a detailed one, with the description of his or her profile of professional Competencies. 5. The candidate may add, in his private area, the profiles of the public positions described in our platform that he/she considers appropriate, with the professional Competencies required in them. 6. The candidate can also compare his or her profile with the profile required in each of those positions. 7. The profiles of professional Competencies of the positions to which the candidate can access have been introduced in our platform by companies or other organizations, and may or may not be related to a job offer. 8. The candidate can also see the profiles of public professional Competencies of other applicants of our platform. 9. The candidate will be able to manage and modify the visibility and comparison settings of his profile of professional Competencies from his private area on our platform. 10. The candidate will be able to know who has seen and who has compared his profile of professional Competencies. 11. The candidate may invite other applicants to register in D'Anchiano and may receive notifications when their guests have completed the professional skills test. 12. The candidate will be able to receive notifications when there are relevant levels of coincidence between his or her competency profile and that required in any of the profiles of the positions entered in our platform.
DESCRIPTION OF THE OPERATION FOR COMPANIES 1. The company registers by filling out a form containing the data fields listed in section 2.2 of this document. 2. Once registered, the company will be able to describe in its private area the profiles of professional competencies required for each of the positions it considers appropriate. 3. For a job description, the company must fill in a data form containing the fields listed in section 2.2 of this document. 4. Once the data questionnaire for a position has been completed, the company should determine, from the list that will be provided to it, between three and six relevant competencies for that position. It must also determine between three and six competencies that are not relevant to the position. 5. Once the description of the relevant and non-relevant competencies of the position has been completed, the company will be able to see a summary report and a detailed one with the description of the profile of professional competencies of that position. 6. The company may add, for each of its positions, the public profiles of the applicants it deems appropriate, with the professional competencies manifested by each of them. 7. It may also compare the competencies profile required by each of its positions with the profile stated by each of the added applicants. 8. The professional competencies profiles of the applicants that the company can access have been defined in our platform by each of the applicants. 9. The company will be able to manage and modify the visibility and comparison of the professional competencies profile of each of its positions from its private area of our platform. 11. The company will be able to know who has seen and who has compared the professional competencies profile of each of their positions. 12. The company will be able to invite its applicants to register with D'Anchiano and will be able to receive notifications when their invitees have completed the competencies test. 13. The company will be able to receive notifications when there are relevant levels of coincidence between the competencies profile required in one of its positions and the one defined by one of the applicants of our platform.
DESCRIPTION OF FUNCTIONING FOR ASSOCIATES (Employment portals, training portals, universities, consultancies, recruiters, ETTs ...) 1. The associate is registered, completing a data form that contains the fields listed in section 2.2 of this document. 2. Once the registration is made, the associate can download different API's from our platform to insert them in its website. Through them, tehir applicants and/or companies can operate on our website from the partner's website. 3. With each one of the different partners, the details of the issues related to access, assignment, treatment and ownership of the information that is shared will be negotiated.
