PRIVACY POLICY AND DATA PROTECTION OF USERS

For KNOWLEDGE TO DECIDE the private life of Users or visitors is paramount. In terms of data protection, since Spain is the country in which the person responsible for the file is established, the provisions of the European Union Regulation, 2016/679, of 27 April 2016 (RGPD), are applicable to this contract.

1. Data Protection Law

Who is responsible for processing your data? The person in charge is KNOWLEDGE TO DECIDE K2D, S.L., with CIF B66172792, domiciled in the 34, Sant Bonaventura St,1st Right, 08301, of Mataró (Barcelona).

How have we obtained your personal data? We have obtained your personal data through previous or current relationships that you have maintained or maintain with KNOWLEDGE TO DECIDE: as a recipient of our services, as a participant in our campaigns or because you have requested information from us. KNOWLEDGE TO DECIDE is entitled to collect your data as a result of the contractual obligations of that relationship. These data are suitable for the purposes described in the following point. You have the right to withdraw your consent at any time by e-mail to protecciondedatos@danchiano.com. The information you have provided to us or may provide to us in the future is used strictly for the following purposes, as appropriate: to process your enquiries and/or requests, to verify your identity and to send you information related to the provision of our services. We will keep the data you have provided us for the duration of our relationship, until you revoke your consent or for as many years as necessary to comply with legal obligations. Subsequently, the data collected will be destroyed with privacy guarantees.

To whom can we provide your information and why? Your data may be transferred to the following recipients, for the following reasons: Suppliers who need access to the data for the provision of services that KNOWLEDGE TO DECIDE has contracted: companies that provide IT services or advice, payment service providers, third parties that help us provide digital or electronic commerce or marketing services or campaigns to promote our services, and third parties who perform statistical work. KNOWLEDGE TO DECIDE will sign with all of them the confidentiality and personal data treatment contracts required by the privacy protection regulations. What are your rights? You have the right to obtain confirmation as to whether or not the data controllers are processing personal data concerning us. You can exercise the right of access, rectification, suppression and portability, limitation and/or opposition to the processing. What about cookies? KNOWLEDGE TO DECIDE may use cookies when a user browses its website. Cookies are files sent to the browser by means of a Web server in order to record the activities of the user during the time of navigation. The cookies used by our website are associated with exclusively with an anonymous user and their computer, and do not themselves provide personal data of the user. By accepting the content of these CGU, the user gives KNOWLEDGE TO DECIDE express consent for the processing of personal data provided. The User knows that, by default, the profile and graph of Competencies is public in the APP/PLATFORM, so it will be accessible to third parties. By accepting these CGU, the Responsible is being authorised to publish the information provided by the user and to publish his image or images that he has uploaded for this purpose. The User also knows that the profile data, which will be published on the APP/PLATFORM, may originate from third party portals or social networks, and consents at the time of allowing access to their social network, as well as at the time of accepting these CGU. The personal data obtained will be used exclusively by KNOWLEDGE TO DECIDE within the framework of this contract. Users who accept these CGU, may receive by KNOWLEDGE TO DECIDE commercial communications, own and third parties. Users may at any time notify KNOWLEDGE TO DECIDE that they no longer wish to receive such communications, through the email address bajas@danchiano.com or through the system it offers to unsubscribe. To communicate to third parties the personal data of Users, KNOWLEDGE TO DECIDE will request, with previous character, their express consent.

2. Personal data collected by KNOWLEDGE TO DECIDE

Al darse de alta en la APP/PLATAFORMA, el Usuario tiene que comunicar una serie de informaciones de acuerdo con el art. 2.2 de las CGU. Dichos datos personales pueden ser de carácter público o privado. Se considerarán como datos personales de carácter privado y, por ende, como datos protegidos, los siguientes: - Las comunicaciones intercambiadas entre los Usuarios, - La dirección mail de los Usuarios, - La contraseña de los Usuarios, El resto de datos personales comunicados por los Usuarios se considerarán datos de carácter público, sin perjuicio de los medios disponibles al usuario en la APP/PLATAFORMA para configurar distintos niveles de privacidad. Con carácter general, los datos personales de carácter privado que los Usuarios comuniquen no serán en ningún caso transmitidos a terceros sin su consentimiento, se conservarán protegidos y únicamente serán utilizados en la ejecución de los Servicios, para la formación del contrato y para comunicar con los Usuarios. Únicamente tienen acceso a estos datos personales algunos empleados de KNOWLEDGE TO DECIDE y de sus subcontratistas que están especialmente habilitados para ello y han firmado el correspondiente compromiso de confidencialidad, según la legislación vigente. A los datos personales de carácter público tienen acceso los otros Usuarios de la APP/PLATAFORMA o aquellos que puedan acceder a través de plataformas de terceros (como empleadores) y pueden difundirse en cualquier video y/o documento en el que KNOWLEDGE TO DECIDE promocione la APP/PLATAFORMA y sus Usuarios. EL gráfico de competencias se realizará mediante un algoritmo, que será privado y no accesible a los usuarios, y que en cualquier caso se encuentra legalmente protegido por KNOWLEDGE TO DECIDE. En cumplimiento de lo dispuesto en las normativas del reglamento de la Unión Europea, 2016/679, de 27 de abril de 2016 (RGPD)), KNOWLEDGE TO DECIDE K2D, S.L. como responsable del/los fichero/s, informa que los datos personales que el usuario facilitará durante toda su relación con nuestra compañía, incluida su dirección de e-mail y todos aquellos datos personales a los que podamos acceder durante la relación establecida, serán tratados en un/os fichero/s debidamente inscrito/s según las directrices del RGPD y de conformidad con lo establecido en la legislación vigente. La información que nos pueda ser remitida, se incorporará a los sistemas de información de KNOWLEDGE TO DECIDE K2D, S.L. Dicha comunicación se utilizará exclusivamente para atender a su consulta. El acceso a tus datos personales será efectuado por personal autorizado y sujeto asimismo a una obligación de secreto, y serán tratados de conformidad con las normativas del reglamento de la Unión Europea.

3. Communications and Notifications

Any communication sent will be incorporated into the information systems of KNOWLEDGE TO DECIDE K2D, S.L., by indicating your data, and in accordance with current legislation. Likewise, the user will receive notifications when any of the professionals invited to register in D'Anchiano has completed the competencies test, or there are relevant levels of coincidence between their competence profile and the one required in any of the profiles of the positions introduced in the APP/PLATFORM, or a company or other professional asks permission to view their profile, or in cases similar to those described above.

4. Photos

By registering in the APP/PLATFORM, the Users who publish it accept the publication of their photo in their profile as well as, if applicable, in any video treatment or in any document in which KNOWLEDGE TO DECIDE promotes the APP/PLATFORM and its Users. Users may modify their profile photo at any time. The User must appear in the photo uploaded to the APP/PLATFORM. Topless or nude photos are strictly prohibited. Any publication of sexual photos can lead to the suspension of access to the account or the termination of the contract for serious fault and automatically.
